Please read these Terms of Service ("Terms") carefully before using FearAlert ("Service", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
FearAlert provides automated market data alerts for informational purposes only. You must be at least 18 years old to use the Service. You agree to use the Service only for lawful purposes and in accordance with these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use of your account at [email protected].
FearAlert is offered on a subscription basis. By starting a paid subscription, you authorise us to charge your payment method on a recurring basis at the then-current price. You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.
We offer a 1-month monitoring trial after you add a payment method. If you cancel during the trial, your payment method will not be charged.
FearAlert provides informational alerts only and does not provide financial advice. Nothing in the Service constitutes investment advice, a recommendation to buy or sell any security, or an offer to provide financial services. You should consult a qualified financial adviser before making any investment decision. We are not responsible for any investment decisions you make based on information provided by the Service.
We strive to provide accurate and timely market data. However, we make no representations or warranties about the accuracy, completeness, or timeliness of any data or alerts delivered by the Service. Market data is sourced from third-party providers and may be subject to delays, errors, or interruptions beyond our control.
Market data may be obtained from licensed providers including Tiingo and Alpha Vantage, where configured or required.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service; (c) reverse engineer, decompile, or disassemble any part of the Service; (d) use automated means to access the Service in a manner that exceeds reasonable personal use; or (e) resell or redistribute the Service or any data derived from it without our express written consent.
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and the FearAlert brand — are owned by us or our licensors and are protected by applicable intellectual property laws.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
